Teva lifts outlook faces Wyeth reflux-patent claim

Wyeth said that the court said Teva had raised enough questions about the patent’s validity to prevent issuance of an injunction. But the court also said that at trial Teva would have to prove “by clear and convincing evidence that the patent is not valid. ” The Protonix patent will expire in July 2010 “but Wyeth’s marketing exclusivity may be extended until January 2011 as a result of clinical research undertaken by the company regarding the pediatric use of the product” Wyeth said. Teva said that the two sides have begun discussing a settlement and that they’ve entered a standstill agreement under which Teva won’t ship more of the product for 30 days. Regarding the second approvable letter Wyeth received on its osteoporosis drug the FDA said several questions remained “regarding issues that had been previously identified during the review process and that were not fully resolved” by Wyeth’s response to the first approvable letter which was issued in April the drugmaker said. The FDA wants “further analyses and discussion concerning the incidence of stroke and venous thrombotic events” Wyeth said. “The agency also identified certain issues concerning data collection and reporting and requested additional source documents.
